Court orders APGA factional chairman’s arraignment

A Federal Capital Territory High Court has granted the Police High Command leave to arraign the factional National Chairman of the All Progressives Grand Alliance, Alhaji Sadeeq Masalla, for allegedly forging the signatures of some members of the party’s National Working Committee.

The court presided by Justice Peter Kekemeke, granted the order after listening to an application brought by police prosecutor, Mr. Francis Irabor, in Charge Number CR/36/12 between the Inspector-General of Police and Masalla.

The court fixed November 21, 2012 for Massalla’s arraignment.

The police counsel’s application for the court’s permission to prefer criminal charges against Massalla was brought under Section 185 (b) of the CPC and pursuant to Rule 3 of the criminal procedure (application for leave to prefer a charge in the High Court Rules, 1970) and under the inherent jurisdiction of the court.

Irabor informed the court that the application was supported by a copy of the charge in respect of which the leave of the court was sought, a copy of the proof of evidence which would be relied on during trial, a copy of the list of witnesses, a copy of the list of exhibits, affidavit in support of the application, and photocopies of statement of witnesses and the accused person.

According to the charge sheet, Masalla, on June 6, 2012, allegedly forged the signatures of some members of the party’s NWC, including Jolly Ngbor, Chris Ndigwe, Dr. Gbenga Afeni, and Abubakar Adamu.
